KENYA: Recording Import IPR Deadline Extended to January 2023

Traders intending to import goods with intellectual property rights (IPR) into Kenya now have until 1 January 2023 to record their IPR with the Kenyan Anti-Counterfeit Authority (ACA), extending the previous deadline of 1 July 2022. A notice was issued on 24 May 2022, updating Public Notice No.1 of 2022 issued on 26 April. Recording IP rights is mandatory for all businesses importing branded goods into Kenya, irrespective of origin. Unfinished goods and unbranded raw materials are exempt. Non-compliance risks fines and up to 15 years imprisonment. The ACA will seize goods lacking its anti-counterfeit security device.
IPR owners, or their licensees or assignees, must submit applications through the ACA Integrated Management System. Applications require information about the rights owner; country of production; distributors and foreign users; goods samples or digital photos; and a certified copy of Kenyan IP registration. Those who meet the requirements will receive an anti-counterfeit security device. The registration is valid for 12 months and is renewable.
