U.S. Industry Proposes Trade Measures to Cope with COVID-19’s Economic Impact

Appeals Court Rejects Challenge to Presidential Authority to Impose Remedies under Section 232

The U.S. Court of Appeals for the Federal Circuit on 28 February rejected a challenge to the legality of Section 232 of the Trade Expansion Act of 1962. While the plaintiff plans to appeal this decision, it is up to the U.S. Supreme Court to decide whether to accept the case for review. A separate case involving the recent expansion of the Section 232 tariffs on steel and aluminium to cover derivative products is currently being considered by the U.S. Court of International Trade. A range of derivative steel and aluminium products now face additional tariffs of 25 percent (steel) and 10 percent (aluminium) following a decision by President Trump to expand the scope of the safeguard tariffs on steel and aluminium.
