Turkey Initiates Expiry Reviews Targeting Chinese-origin Textile Fabrics, Slide Fasteners and Refillable Pocket Flint Lighters

Hong Kong traders with export interests in Turkey may like to know that Turkey has initiated three expiry review investigations concerning the anti-dumping duties previously imposed on certain textile fabrics impregnated with polyurethane, slide fasteners and refillable pocket flint lighters originating in mainland China.

The expiry review concerning textile fabrics impregnated with polyurethane was initiated by Decree No. 2015/47 on the Prevention of Unfair Competition from Imports, published in the Turkish Official Journal No. 29517, dated 30 October 2015. Textile fabrics concerned by this investigation currently fall under Tariff Statistical Positions 5903.20.10.10.00, 5903.20.10.90.00, 5903.20.90.10.00 and 5903.20.90.90.00.

The application for the initiation of an expiry review was filed by Depar Deri Plastik Sanayi ve Ticaret A.Ş., Flokser Tekstil Sanayi ve Ticaret A.Ş. and Doğuş Suni Deri Kösele San. ve Tic. A.Ş. The original measures, which had been maintained after a first expiry review was completed in 2010 by Decree No. 2010/28, had been initially introduced by Decree No. 2005/2 on the Prevention of Unfair Competition from Imports, published in the Turkish Official Journal, No. 25718, dated 5 February 2005.

The rates which had been introduced by Decree No. 2005/2 for textile fabrics impregnated with polyurethane are illustrated in the following table. These will continue to remain in force until the completion of the new expiry review investigation, pursuant to Article 35 of the Regulation on the Prevention of Unfair Competition in Imports:

Hong Kong traders may also like to know that Turkey initiated two other expiry review investigations for the anti-dumping measures on Chinese-origin slide fasteners and refillable pocket flint lighters. The expiry review concerning slide fasteners was initiated by Decree No. 2015/46 on the Prevention of Unfair Competition from Imports, published in the Turkish Official Journal No. 29516, dated 28 October 2015.

The original measures at the rate of 3 USD/kg and applicable to the products concerned, currently falling under Tariff Statistical Positions 9607.11 and 9607.19, had been initially imposed by Decree No. 2005/7 and maintained after an expiry review was completed in 2010, by Decree No. 2010/29. The request for an expiry review was submitted by Ece Fermuar Sanayi ve Ticaret A.Ş. and Fermaş Fermuar Teks. San. Tic. A.Ş., and supported by Afa Fermuar ve Düğme San. Tic. Ltd. Şti., Emr Fermuar San. Tic. Ltd. Şti., Esmaş Kalıp Metal San. Tic. A.Ş., İnci Fermuar San. ve Tic. A.Ş., Roza Tekstil Fermuar San. Tic. A.Ş., Sude Fermuar İml. Teks. Ürün. San. ve Tic. Ltd. Şti. and Tit Fermuar Titbaş Tekstil ve Konf. ve Tic. A.Ş.

The expiry review concerning refillable pocket flint lighters was initiated by Decree No. 2015/48 on the Prevention of Unfair Competition from Imports, published in the Turkish Official Journal, No. 29516, dated 28 October 2015. The original measures at the rate of 0.12 USD/kg and applicable to the products concerned currently falling under Tariff Statistical Positions 9613.20.00.00.19 had been initially imposed by Decree No. 98/4. Thereafter, the applicable duty rate had been reduced to 0.05 USD/kg after an expiry review was completed in 2004, by Decree No. 2004/25 and maintained at 0.05 USD/kg after the second expiry review which was completed in 2010, by Decree No. 2010/27. The request for the third expiry review was submitted by Azmüsebat Çelik San. ve Tic. A.Ş.

Within the framework of the above-mentioned three expiry review investigations, importers, producers and exporters of the products under investigation will be notified of the initiation of the investigation. Notified parties are required to submit their responses to the questionnaire, in Turkish, within 37 days from the date on which the notification was sent, including the time spent for delivery. For other interested parties, who do not or have not received a notification, the 37-day deadline starts as from the publication date of the announcements in the Turkish Official Journal, including the time spent for delivery.

Interested parties failing to submit their responses within the deadline will be considered as not cooperating, and the relevant determinations, within the framework of the investigations, will be made based on the facts available, which may lead to unfavourable or less favourable consequences compared to cooperating parties.

In the case where the Turkish Ministry of Economy decides to recalculate the normal value, interested parties are also invited to submit evidence proving that market economy conditions apply in mainland China. If such claim cannot be substantiated by evidence, normal value calculations will be based on a constructed value, the calculation of which will be based on Turkey as the analogue country.
