FIEs No Longer Classified as Equity or Co-operative Joint Ventures

The State Council recently announced a decision to revise or abolish some administrative regulations that are inconsistent with the Foreign Investment Law (State Council Decree No. 732). Items in 22 administrative regulations were revised and the changes took effect on 29 November. Under the amendment, foreign-invested enterprises (FIEs) are no longer classified as “Sino-foreign equity joint ventures”, “Sino-foreign co-operative joint ventures” or “foreign-invested enterprises”, and their organisational structures and forms are subject to the provisions of the Company Law, the Partnership Enterprise Law and other laws. The Measures for the Administration of Establishment of Partnership Enterprises in China by Foreign Enterprises or Individuals have been abolished
