China to Implement Anti-Monopoly Reviews on Business Operators

The State Administration for Market Regulation (SAMR) recently released Interim Provisions on the Review of Concentration of Business Operators, which will take effect on 1 December 2020. Under the Interim Provisions, SAMR is responsible for conducting anti-monopoly reviews relating to concentrations of business operators, and for investigating and handling illegal concentrations.
According to Article 20 of China’s Anti-Monopoly Law, “concentration” of business operators relates to mergers of business operators, one business operator acquiring control over others by acquiring their equity or assets, or an operator acquiring control or decisive influence over others by way of a contract or any other means.
