Supreme People’s Court Strengthens IPR Judicial Protection

On 21 April, the Supreme People’s Court published its opinions on strengthening judicial protection of intellectual property rights (Fa Fa No. 11 [2020]). It said that doing so would not only bolster China’s adherence to international rules but also further its high-level economic development and opening up.
The Supreme People’s Court calls for efforts to effectively protect the legitimate rights and interests of rights holders. In particular, it mentions the need to protect the fruits of technological innovation, trademark rights, copyrights and commercial secrets. It also stresses the need to improve rules for identifying intellectual property right infringements of e-commerce platforms, promote the circulation and application of intellectual achievements and punish acts of violation of intellectual property rights in accordance with law. Moreover, it calls for protection of the legitimate rights of domestic and foreign entities on equal footing, the proper hearing of intellectual property rights disputes relating to international trade and foreign investments, and adherence to equal legal protections.
