Plastic Apparel, Face Masks, Medical Items Among New China List 3 and List 4A Tariff Exclusions

Additional exclusions from the Section 301 additional 25 percent tariff on List 3 goods from mainland China have been announced by the Office of the U.S. Trade Representative. The affected products are certain sacks and bags of polymers of ethylene classified under HTSUS 3923.21.0030 and 3923.21.0095; plastic apparel articles classified under HTSUS 3925.20.9050; disposable rubber gloves, mittens and mitts, seamless, other than surgical or medical, classified under HTSUS 4015.19.1010; and certain non-woven man-made filament fabric weighing more than 25 grams per square metre but not more than 70 grams per square metre classified under HTSUS 5603.12.0090. These exclusions, which must be claimed using new HTSUS subheading 9903.88.41 are reflected in the aforementioned 10-digit HTSUS subheadings covering 75 separate exclusion requests. They will be retroactive to 24 September 2018 and remain in place to 7 August 2020.
USTR has also announced a second set of exclusions from the Section 301 additional tariff on List 4A goods from mainland China, which was initially set at 15 percent but was lowered to 7.5 percent effective 14 February. The exclusions cover items such as surgical and medical items, plastic medicine dispensing cups, cold packs, hot packs, eye compresses, disposable shoe and boot covers and shoe cover dispensers, textile face masks and medical masks, and gel pads of textile materials. They are reflected in 19 specially prepared product descriptions covering 39 separate exclusion requests and must be claimed using new HTSUS subheading 9903.88.42. These exclusions will be retroactive to 1 September 2019 and remain in place until 1 September 2020. A copy of the relevant USTR notice is available here.
These product exclusions are available for any product that meets the specified product description, regardless of whether the importer filed an exclusion request. The scope of each exclusion is governed by the scope of the product descriptions set forth in the USTR notice and not by the product descriptions in any particular request.
