'Internet Factors' to be Included in Revised Anti-Monopoly Law

14 January 2020

China is considering adding a new clause to its anti-monopoly legislation, in relation to determining the dominant market position of business operators in the internet sector. The new clause would specify “other factors relevant to the determination of the dominant market position of the business operator.” These factors would include online impact, scale, lock-in effect and ability to grasp and handle relevant data.

Entities and individuals concerned may voice their opinions on the above and other proposed amendments set out in the Draft Amendment of the Anti-monopoly Law (For Public Comments) via the website of the State Administration for Market Regulation or by email or post before 31 January 2020.
