Opinions on Promoting Small Businesses Through Intellectual Property Rights

According to Several Opinions on Promoting the Development of Small and Micro Enterprises through Intellectual Property Rights issued by the State Intellectual Property Office (SIPO) lately, greater support in terms of intellectual property (IP) will be given to small and micro enterprises in such areas as innovation, application, protection, administration and service. This move aims to alleviate the pressure on the development of small and micro enterprises, and invigorate the potential of entrepreneurship.
SIPO pointed out that currently there are about 11.7 million small and micro enterprises in China, accounting for 77% of the total number of enterprises. However, the majority of small and micro enterprises are found at the lower end of the industry chain, facing such problems as small scale, low product value-added, weak innovative capability, and weak core competitiveness. Hence, their demand for support measures on IP is pressing.
The Opinions put forward that priority should be given to the review of applications for licensed core patent which is in urgent need of small and micro enterprises, and that support would be given to expedite the process of obtaining patent rights abroad by small and micro enterprises. Meanwhile, greater efforts will be made to grant financial aid to small and micro enterprises for their patent application, give priority to small and micro enterprises in offering financial assistance to patent applicants, grant incentive to the first invention patent obtained by small and micro enterprises, and give project aid to small and micro enterprises importing and exploiting patents.
The Opinions also put forward that a small and micro enterprise IP financial service demand survey system should be set up to encourage these enterprises to explore channels for realising IP values by way of collateral financing, licensing and assignment, and equity investments. A small and micro enterprise credit risk compensation fund will be set up to provide key support to IP collateral loan, incorporating IP insurance service into small and micro enterprise guidance policy, and lowering loan, guarantee and insurance rates.
The Opinions state clearly that through such means as government input in guiding fund or purchase of service, support is given to small and micro IP service providers to participate in public IP services. At the same time, efforts will be made to strengthen patent administration and enforcement. Taking into consideration the characteristics of small and micro enterprises such as their short cycle of technological innovation, great number of utility model and design patents, and relatively small amount involved, steps will be taken to establish a speedy patent infringement dispute resolution mechanism as soon as possible.
