Miscellaneous Canadian and Latin American AD/CV Actions on Chinese Products

Canada to Issue AD/CV Duty Orders on Aluminium Extrusions . On 17 March, the Canadian International Trade Tribunal issued a final affirmative injury determination in its AD and CV investigations of certain aluminium extrusions from mainland China. The scope of these investigations covers aluminium extrusions produced via an extrusion process, of alloys having metallic elements falling within the alloy designations published by The Aluminum Association commencing with 1, 2, 3, 5, 6 or 7 (or proprietary or other certifying body equivalents), with the finish being as extruded (mill), mechanical, anodised or painted or otherwise coated, whether or not worked, having a wall thickness greater than 0.5 millimetres, with a maximum weight per metre of 22 kilograms and a profile or cross-section that fits within a circle having a diameter of 254 mm. These goods are commonly classified under HTSCA 7604.10.1110, 7604.10.1190, 7604.10.1211, 7604.10.1219, 7604.10.1221, 7604.10.1222, 7604.10.1223, 7604.10.1224, 7604.10.1229, 7604.10.2011, 7604.10.2019, 7604.10.2021, 7604.10.2029, 7604.10.2030, 7604.21.0010, 7604.21.0020, 7604.29.1110, 7604.29.1190, 7604.29.1211, 7604.29.1219, 7604.29.1221, 7604.29.1222, 7604.29.1223, 7604.29.1224, 7604.29.1229, 7604.29.2011, 7604.29.2019, 7604.29.2021, 7604.29.2029, 7604.29.2030, 7608.10.0010, 7608.10.0090, 7608.20.0010 and 7608.20.0090.
As a result of the CITT’s determination, the CBSA will assess AD and CV duties on all appropriate entries using the rates shown in the table below.

Brazil Issues Preliminary Affirmative Determination in AD Investigation of Viscose Single Yarn. Brazil’s Ministry of Development, Industry and Trade recently issued a preliminary affirmative dumping determination in its AD investigation of mainland Chinese single yarn containing 85 percent or more by weight of viscose staple fibres classified under NCM 5510.11.00. The MDIT established an AD duty of US$0.57 per kilogramme on imports of subject merchandise through 15 September 2009.
Argentina Initiates AD Proceeding on Certain Road Wheels, Announces Scheduled Expiration of Order on Air-Conditioning Equipment. Argentina’s Department of Industry, Commerce and Small and Medium Enterprises has initiated an AD investigation of mainland Chinese steel road wheels with a nominal diameter between 444.5 mm (17.5 inches) and 622.3 mm (24.5 inches) and a nominal width equal to or higher than 152.4 mm (six inches), for use in buses, lorries, trailers and semi-trailers, classified under NCM 8708.70.90 and 8716.90.90. Interested parties may submit evidence and information related to this investigation by 18 May. Argentinean Customs will begin requiring certificates of origin for subject merchandise from 9 June.
Separately, Argentina has announced that the AD duty order on mainland Chinese air-conditioning equipment classified under NCM 8415.10.11, 8415.10.19, 8415.83.00 and 8418.61.10 is scheduled to expire on 16 August 2009. These products are currently subject to AD measures in the form of minimum FOB prices ranging from US$200 to US$290 per unit. Interested parties have until around mid-May to request that the order be renewed.
