Brazil has issued new procedures concerning the treatment of fragmented industries in trade remedy investigations in an effort to improve these industries’ access to trade remedy protections.
Brazil has issued new procedures concerning the treatment of fragmented industries in trade remedy investigations. Under the new procedures, a fragmented industry, defined as a sector with a particularly large number of domestic producers, will benefit from more flexible timeframes and therefore enjoy enhanced access to trade remedy mechanisms. Several fragmented industries in Brazil in both the industrial and agricultural sectors have faced significant difficulties in the past complying with relatively stringent deadlines. Applications for fragmented industry status must be submitted to the Department of Trade Defence (DECOM), which will either approve or deny them.
